Hi,
I am graduate student in Clinical Psychology. I am going to be working for a state employer during summer. This is mandatory for my program and I will receive 6 credits for it by the end of summer. However, due to some graduate school rules, I will have less than minimum credits to take during the Fall '10 and Spring '11 semesters. I was wondering if I could go ahead and work on CPT during summer (the employment is not paid), but register for those credits during Fall '10 and Spring '11 (breaking it up into 3 credits each) which will ensure my minimum registration.
Also, can I apply for CPT during a semester when I have taken minimum credits required and I am a TA (full 20 hours)?

You need ask your school officials regarding their CPT policy. It varies from school to school.

I dont think this is going to affect non immigrant community (read as H1s, GC etc). This is all about politics to gain the support of rich and influential Indian American community for the DNC and upcoming elections.

i am planning to file eb2 and port my eb3-i140 pd. My current position is system analyst with eb3 job requirement. I can get a promotion but that doesnt qualify for eb2 job requirement. So i am planning to move to a different position, research associate which qualifies for eb2(it requires masters degree) with the same employer. Can i file eb2 with this position and port my eb3-i140 pd? Advice pls.

I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

thanks! but one more thing is that I don't have H-4 approval notice/petition; but I have I-94 valid till 2009. Will this do for H1 approval????
Looks like your Husband got H1-B extension till 2009; per my knowledge you should have file I-539 along with your husband to get your H4 approval till 2009, if you didn't do it then looks like you need to do right away..or consult your attorney ASAP, I-94 card is doesn't validate your H4 status...
I am NOT a Lawyer; you many consult lawyer...this type of mistake my friend's did in past...

When I returned US, Immigration office issued me I-94 validity until September 23, 2011. Now how long I can stay in US?? Do I need to apply for H1B visa extension or I will go to Canada or Mexico to apply for new visa or if I go to Canada or Mexico and return back, they will issue me a new I-94 until Sep/Oct 2012. Any one please suggest what should I do?
Your stay is legal until your I-94 specified date. You can get it resolved by INS or go out of US and reenter (which may turn out to be faster). And this time while entering make sure Immigration officer puts right date on your I-94.

I would suggest to plan in 3 months advance so that you can send all the documents from usa, prepare documents in India and planning the trip.

That is correct. If your employer is enrolled in E-verify then he needs to updated your information in that system otherwise just keep the form for record.

I am in the process of moving between jobs. The old job is a teaching job in a university and the new one is a research position in a non-profit think tank. So there is no H1B quota issue for both jobs.
The H1B for the old job won't expire unit next year. I have received the H1B for the new job. The start date for the new H1B is Sept. 1st.
My question is: Can I start my new job before Sept. 1st? I understand that for H1B transfer, one can start the new job once the application receipt from USCIS is received. But in my case, I have already got the new H1B and the start date on that is Sept 1st.

It appears there is a good allocation of 9.2billion dollars for Healthcare IT in the stimulus. Does it provide impetus for this field?

True up to some extent. When filing AOS, you still "intent" to join for the exact same employment (including location), as specified in your LC. You are NOT required to take that exact employment "at the time" of filing AOS. What is required "at the time of filing AOS" is to have a legitimate intention to take that exact employment upon GC. By joining for that exact employment from anytime now, will actually help in proving the "legitimacy" of your intention (but not "required").
My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

(TOOK ONE MONTH APPROX),
Now the question is,
I AM AWARE THAT SHE HAS TO GET STAMPED IF SHE TRAVELS TO INDIA, BUT what if she travels to India, when on OPT status????
Any seniors had experienced the same situation?????????

As long as your Advance parole is not expired, you should be able to travel with it. If your Advance parole is going to expire around the time you are planning travel; you should renew your advance parole.
